The Douglas County Board of Commissioners are responding to those opposing last week’s resolution regarding sanctuary status in Douglas County.
Information from Chief Public Information Officer Tamara Howell said because the county has received notice of potential litigation, it is the longstanding practice of Douglas County not to comment on matters that are pending or reasonably anticipated to become the subject of litigation.
Howell said in light of questions and what they believe is misinformation circulating within the community, the board wants to provide factual clarifications regarding the adoption of the resolution:
Commissioners say:
*The resolution was legally adopted as the board followed all applicable legal requirements and procedures for the adoption of a resolution during a public meeting.
*The matter was presented during a properly noticed public meeting. The resolution was considered during a properly noticed agenda item from the Douglas County Citizens Coalition for the board to consider issuing a formal statement or resolution expressing support for all levels of law enforcement and their ability to carry out their duties without interference and in compliance with all local, state, and federal laws. The board deliberated on the matter in open session and adopted the resolution during a public meeting.
*The resolution, meeting minutes, and meeting recording have been publicly available since adoption.
*Disagreement with a public resolution does not change the legal process that was followed. The commissioners and Douglas County will not be providing any additional comments or conducting interviews on this matter while litigation is pending or reasonably anticipated
