HARNEY COUNTY JUDGE TEMPORARILY BLOCKS MEASURE 114

Only hours after a U.S. District Court Judge put Ballot Measure 114’s permit-to-purchase requirement on hold for thirty days, while allowing the rest of the law to go forward, a Harney County Judge granted a temporary restraining order to stop the entire ballot measure from taking effect on Thursday.

Circuit Court Judge Robert S. Raschio’s decision came in a case brought by Gun Owners of America, its legal defense fund Gun Owners Foundation, and two Harney County gun owners. Raschio said the ballot measure’s implementation would be a violation of Oregonian’s state constitutional rights.

Earlier Tuesday Judge Karin J. Immergut issued a 43-page ruling and said the plainiffs in lawsuits brought by the Oregon Firearms Association, three Oregon sheriff’s and two gun-store owners had failed to show that they will suffer “immediate and irreparable harm” if the measure were to take effect. However, Immergut did agree to stay the permitting provisions in light of the difficulties the State has conceded to.

Judge Raschio also included a Show Cause order against the State of Oregon, with a hearing scheduled for December 13th.

Oregon Public Broadcasting is reporting that a spokesperson for the Oregon Department of Justice said the agency will file a petition asking the Oregon Supreme Court to review the case immediately.
